The solution:  We need more John Rufus Rains descendants involved.  ***** Can each of you ask members of your extended family to get involved? ***** We need to swell the ranks and discourage them.  We also need media attention and social media attention.  I hand delivered the Rule 60 motion to reporters at both the Tennessean & the Nashville Scene.  They haven't run any stories yet.  If any of you are good at getting media attention or social media campaigns, we need attention.  Some of you have given me descendant lists with over 100 surnames.  After 200 years, I suspect the living descendants are more than 500 +.  Perhaps some are lawyers or paralegals who can help.  Perhaps others are looking for a just cause.  We need them all.  The more people who surface, the less likely they will attempt to depose everyone, including you.  I've also considered starting fundraising efforts to fund an account to pay for expenses.  One of those expenses could be a 1/2 to full page add in the Tennessean seeking descendants of Captain Rains and his son John Rufus Rains and listing possible surnames.  A full page add is about $2,000.  That would certainly swell the ranks and get attention.

 

Anything each of you could do is most appreciated. 

 

Also, as you know I am not charging descendants or other interested persons a fee.  Pro Bono means "no expectation of being paid" and I have none from you guys.  However, I did find case law that may require the "other side" to pay my fee if successful.  It is a stretch, but attorney fees are allowed on Slander/Libel of Title actions.  I am taking the position this Rule 60 motion is a necessary step in a Slander/Libel of Title action.  After all, they are representing to the world that they own title to your family cemetery.  I can't sue them for Slander/Libel of Title until I win the Rule 60, so it is a necessary step.    

 

I will be in touch as things progress.  I've attached their Notice of Appearance and Motion for Continuance.

Dear Rains Descendants,

 

I hope this email finds you all well.  The Petitioners (Bad Guys), Ashkazari & Akbari, have hired new counsel, Neal & Harwell.  In case you don't know, this is the best law firm in Nashville, in Tennessee, and one of the best in the nation.  This firm successfully defended Elvis' M.D., Gov. Edwin Edwards of LA, Exxon in the Exxon Valdez spill, Ford Motor Co. in the Pinto gas tank case etc. etc.  The good news is you don't hire Neal & Harwell unless your in big trouble.

 

They have asked, on an expedited basis, to continue my Rule 60 motion so they can take discovery.  They want to make each of you answer written discovery and want to take each of your depositions along with Dan Allen and other witnesses.  They want the Judge to hear their Motion in the next 72 hours.  Of course, I will fight it.  I say your testimony will never change the fact that under the law you can't adversely possess a cemetery.  I don't know how the Judge may rule.  I do know the Judge, an excellent former assistant attorney general for many years, sent formal notice to the AGs office asking them to get involved.  They represent the interests of the State of Tennessee. They could get involved under a state historical/archeological theory or to investigate the bad apples (council member, lawyer, petitioners for criminal investigation, or both.  If the Judge is angry enough to refer it to his former boss, the sitting Attorney General, he is upset at what was done to him & you guys.  That is a good thing.

 

The bad news is that Neal & Harwell wins these wars by attrition.  They want to smother you all with paper until you give up.  The lawyer, Jim Kelley, told me he would send me discovery that I had no chance of answering.  It will be intimidation and harassment until you guys give up.  They think the number of descendants actively fighting this is 6-8.  They want to pick you off one by one.

The Rains Cemetery descendants are ready for media attention now. The descendants' lawsuit has been filed. The cemetery destroyers having now seen it fired their original lawyer and hired Neal & Harwell (often said to be the best in Nashville and one of the top in the Nation.) We are hoping to add more descendants to our fight for correcting the destruction of the cemetery. If you know of anyone, they may contact Nashville Attorney J. Please post notices on any websites, groups or genealogical newsletters you can that may reach more descendants (Nashville Pioneer Captain John Rains' son John Rains born 1773 in VA, known in the early years as John Rains Jr until his son became Jr and he became Sr. also known as John Rufus Rains, died 26 September 1855 in Nashville, TN.) My grandmother was born 1862 in Bell Co. TX.

My ggrandmother was Mary Elizebeth Raines ,Her brother was Jake Raines ,who worked for the Spur ranch in Tx.
