issued At Perth : John Marshall carrier in Auchtermuchty Fifeshire and Andrew Lucas son of Andrew Lucas in Kirktoun of Clova were both tried for murder , the former for murdering Thomas Drysdale bookbinder in Dunfermline March 3 1759 by assaulting him when intoxicated with liquor at or near the bridge of Gourly and drowning him in a pool or strangling him with a handkerchief which he wore about his neck

and the latter for murdering David Finlay in Whine m the parish of Cortaehy and Clova December 18 1757 in the hill near Lochorrel by wounding and bruisinghim with the butt end of a gun his death his body having been found two days after in the hill Both libels were found not proven and both pahnels were also ilzied James Lucas Andrew's bro theV was indicted jointly with him but did not appear and was therefore fugitated John Neiths 329 or Neifhes father and son in Millsield
